Lawyer Sankara Nair goes into the testimony of the past four months in his 68 pages long plea. Nair states that the Johnsons must be arrested through an international arrest warrant. After their arrest, they can be extradited to Malaysia. In Kuala Lumpur they can then be heard in a criminal investigation. According to Nair, at least there is death by guilt, on which in Malaysia up to ten years imprisonment.
Fatal
Nair concludes that on December 7, 2017, Ivana had so many drugs and alcohol in her blood that it became fatal. The Johnsons, the American couple with whom she had spent the night , stood by and looked at it. The drugs may have been administered to her by mixing them with sweet cider. The combination and amount of drugs must have led to hyperthermia, overheating of the body, with fatal outcome. No emergency number was called by the Americans.
When Ivana was dead, the Johnsons spent hours thinking about explaining this to the authorities. Malaysia has severe penalties for drug use and drug possession. They decided, according to the Smit family, to make it look like an accident or suicide by throwing her over the balcony. The family never believed in an accident. There are strong indications that deadly stiffness had occurred before Ivana crossed the balcony and fell fourteen floors. That also explains that she was found naked. Once stiffness has entered, it is impossible to dress the body.

Alarm bells
Nair mentions the conclusion of the police that Ivana’s death was an accident, ignorant and biased. Many alarm bells had to go off when the Johnsons came up with half-baked statements that they did not know where Ivana was, while Ivana’s telephones were on the table and her clothes were hanging in the walk-in closet.
Every police officer who took part in the witness box said that the situation was suspicious , but no action was taken. The crime scene was not sealed and only limited DNA research was done. The cider, with which Ivana was possibly stunned, was not examined. The police also went wrong by letting Luna Johnsons call the cleaning lady from the police cell. She mopped the floor of the apartment, cleared out glass shards, and swapped the trash bags. It was not until they had finished that the technical investigation department entered the apartment for trace research. On the 29th of March the Johnsons left Malaysia. They say they are innocent .
