Saiful suffered anal penetration, say doctors
KUALA LUMPUR: Two Hospital Kuala Lumpur doctors told the High Court here that Mohd Saiful Bukhari Azlan had suffered anal penetration as there was presence of semen in his high and low rectal areas.
Forensic pathologist Dr Siew Sheue Feng and Emergency Care specialist Dr Khairul Nizam Hassan had previously said in their medical report that there were no conclusive clinical findings suggestive of penetration to the anus/rectum of Mohd Saiful.
The medical report dated July 13, 2008, had been prepared by them and Dr Mohd Razali Ibrahim, another witness in opposition leader Datuk Seri Anwar Ibrahim’s second sodomy case.
Mohd Saiful had a medical check-up in HKL on June 28, 2008.
In his examination-in-chief by deputy public prosecutor Datuk Nordin Hassan, Dr Khairul Nizam said that by comparing his report with the chemist report dated July 11, 2008 (which listed parts of the body where swabs were taken), he could conclude that there was penetration.
He said the findings of the report were consistent with “penile penetration” and added that although initial clinical findings did not suggest a penetration, it did not mean there was no penetration.
When asked under what circumstances could penetration happen without signs of injury, he replied: “Duration of time taken by the victim from the time of the incident to the time he goes to see a doctor, (if there is) no resistance and the use of lubricants.”
He also agreed that the medical report prepared by them had not been complete and comprehensive.
Anwar, 63, had claimed trial to a charge of sodomising Mohd Saiful, 25, at Desa Damansara Condo?minium in Jalan Setiakasih, Bukit Daman?sara, on June 26, 2008.
Leading the prosecution was Solicitor-General II Datuk Mohd Yusof Zainal Abiden, while lawyer Karpal Singh led Anwar’s defence team.
Earlier, Dr Siew told the court that Mohd Saiful told him that he had been sodomised over a period of two months by a high-profile public figure without the use of a condom.
In the medical report, the doctors had also concluded that there was “no significant defensive wound on the body of the patient”.
It also noted that the “perianal area was moist” but that the “external area of the anus showed no scarring, fissure or any sign of recent injuries”.
Speaking to reporters later, Anwar’s counsel S. N. Nair said Anwar would file contempt applications against “three or four persons” early next week over comments made by them through the media, which he said amounted to sub judice.
However, he declined to elaborate.
